1. Scope of Application

These Terms and Conditions govern the use of the Flow Lab mobile application (the "App") and related services provided by Quantum Craft UG (haftungsbeschränkt) ("we", "us", or "Provider"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

2. Description of Services

Flow Lab is a mental fitness training application that provides guided audio sessions, personalized training plans, and progress tracking to help users improve their mental and emotional well-being. The App offers both free and premium subscription-based content.

3. Registration and User Account

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

4. Contract Conclusion

The presentation of the App in app stores does not constitute a binding offer. By downloading the App and creating an account, you submit a binding offer to conclude a usage agreement. The contract is concluded when we activate your account or when you gain access to the App's services.

5. Subscription and Pricing

Certain features require a paid subscription. Current prices are displayed in the App and the respective app stores. Subscriptions are billed through Apple App Store or Google Play Store. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage your subscription in your app store account settings.

6. Free Trial

We may offer free trial periods for premium features. At the end of the trial, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends. Trial eligibility is determined by the app store and may be limited to one trial per user.

7. Right of Withdrawal

If you are a consumer in the European Union, you have the right to withdraw from the contract within 14 days without giving any reason. The withdrawal period expires 14 days from the day of the contract conclusion. To exercise this right, contact us at flowlab@quantumcraft.io with a clear statement of your decision. For digital content, you may lose your right of withdrawal once download or streaming has begun with your express consent.

8. User Obligations

You agree to use the App only for lawful purposes and in accordance with these Terms. You must not: (a) use the App in any way that violates applicable laws; (b) attempt to gain unauthorized access to our systems; (c) share your account credentials with others; (d) use the App to transmit harmful or offensive content; (e) reverse engineer, decompile, or disassemble the App.

9. Intellectual Property

All content in the App, including but not limited to audio recordings, text, graphics, logos, and software, is owned by us or our licensors and is protected by copyright and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

10. Health Disclaimer

The App provides mental fitness training for general well-being purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. If you have or suspect a mental health condition, please consult a qualified healthcare provider. We are not responsible for any health decisions made based on App content.

11. Liability

We are liable without limitation for damages caused by intent or gross negligence. For slight negligence, we are only liable for breach of essential contractual obligations, limited to foreseeable, typical damages. We are not liable for indirect, incidental, or consequential damages to the extent permitted by law.

12. Data Protection

We process your personal data in accordance with our Privacy Policy and applicable data protection laws, including the GDPR. By using the App, you consent to such processing. Please review our Privacy Policy for details.

13. Termination

You may terminate your account at any time by contacting us or through the App settings. We may terminate or suspend your access for violation of these Terms or for any other reason with reasonable notice. Upon termination, your right to use the App ceases immediately.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or by email. Your continued use of the App after such notification constitutes acceptance of the modified Terms.

15. Dispute Resolution

For EU consumers: The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr. We are not obligated and generally not willing to participate in dispute resolution proceedings before a consumer arbitration board.

16. Final Provisions

These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protection laws of your country of residence may also apply. If any provision of these Terms is found invalid, the remaining provisions remain in effect. The place of jurisdiction for merchants is Berlin, Germany.
